The Annual Law for the Market and Competition no. 124/2017, as amended by Decree-Law no. 34/2019, converted by Law no. 58/2019 (Official Gazette no. 151 of 29 June 2019), sets out publication obligations for recipients of grants of €10,000.00 or more.
The Law establishes that the recipients referred to in Article 1, paragraph 125 must publish on their websites or similar digital portals, by 30 June each year, information on the public grants/funding indicated therein actually paid out in the previous financial year (starting from 2018).
Recipients under paragraph 125-bis, Art. 1, Law no. 124/2017 – who carry out the activities referred to in Article 2195 of the Italian Civil Code – must publish, in the notes to their annual financial statements and to any consolidated financial statements, the amounts and information on the public grants/funding referred to in paragraph 125 actually paid by public administrations, as defined in Art. 1, paragraph 2 of Legislative Decree no. 165/2001, and by the entities referred to in Art. 2-bis of Legislative Decree no. 33/2013 (including those indicated where the conditions of paragraph 3 are met).
Recipients that prepare abridged financial statements under Article 2435-bis of the Civil Code, and those not required to prepare notes to the financial statements, fulfil the same publication obligation, for the same information and amounts, by 30 June each year on their own websites, in a form freely accessible to the public or, failing that, on the digital portals of the trade associations they belong to.
Failure to comply with paragraphs 125 and 125-bis of Law no. 124/2017 leads to penalties from 1 January 2020.
Paragraphs 125-quater, quinquies and sexies concern, respectively, the publication obligations for payments made by central State administrations, State aid and de minimis aid, and the publication obligations for social cooperatives working for foreign nationals under Legislative Decree no. 286/1998.
Paragraph 126 extends the obligations of Art. 26 of Legislative Decree no. 33/2013 to bodies and companies controlled by State administrations, which must publish them in their annual accounts, in the notes to the financial statements, with a penalty (equal to the amount paid) for failure to comply.
The publication obligations under paragraphs 125, 125-bis and 126 apply to amounts of €10,000.00 or more.
